Terms of Service

1. Acceptance of Terms

By accessing or using the Conflai platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. The Service is operated by Conflai SLU, a Spanish limited company with registered office in Alicante, Spain.

2. Description of Service

Conflai provides AI compliance documentation, risk classification, monitoring, and Trust Seal services to help organisations demonstrate compliance with the EU AI Act (Regulation (EU) 2024/1689). The Service includes the AI Compliance Autopilot, AI Trust Seal, and Compliance Vault modules.

3. No Legal Advice

The Service does not constitute legal advice and does not replace counsel from a qualified attorney, Data Protection Officer, or notified body. All classifications, generated documents, and Trust Seals are AI-assisted drafts subject to human review. You are solely responsible for verifying the accuracy and completeness of all outputs before relying on them for regulatory purposes.

4. Accounts and Access

• You must provide a valid business email to create an account.
• Each account is associated with a single tenant (organisation). Multi-tenancy is supported through separate accounts.
• You are responsible for all activity under your account and must maintain the confidentiality of your authentication credentials.
• The administrator who creates the account can invite additional team members with role-based access (admin, editor, viewer).

5. Subscription and Payment

• The Service is offered on a monthly subscription basis. Pricing tiers (Starter, Growth, Scale, Enterprise) are published on the website.
• Payments are processed by Stripe. All amounts are in EUR and exclude VAT unless otherwise stated.
• For EU B2B customers with a valid VAT ID outside Spain, reverse charge applies.
• Subscriptions renew automatically. You can cancel at any time via the billing portal; access continues until the end of the current billing period.

6. AI Trust Seal

The AI Trust Seal is a private contractual attestation issued by Conflai SLU. It is NOT a certification under Regulation (EU) 2024/1689 Annex VII and does NOT bind any supervisory authority. The Seal is valid for 12 months from issuance, subject to continuous monitoring. Conflai reserves the right to revoke a Seal if monitoring reveals material non-compliance.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy and Data Processing Agreement. All customer data is stored in the European Union.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Conflai SLU's aggregate liability for any claims arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim. Conflai SLU shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, regulatory fines, or loss of data.

9. Indemnification

You agree to indemnify and hold harmless Conflai SLU from any claims, damages, losses, or expenses arising from your use of the Service outputs without appropriate legal review, your misrepresentation of the Trust Seal's nature, or your violation of these Terms.

10. Intellectual Property

Conflai SLU retains all rights in the Service, including the platform, algorithms, prompts, templates, and branding. You retain ownership of all data you upload. Generated documents are licensed to you for your internal compliance use.

11. Termination

Either party may terminate the subscription at any time. Upon termination, your data will be retained for 30 days to allow export, after which it will be deleted. Audit logs may be retained longer where required by law.

12. Governing Law

These Terms are governed by the laws of Spain. Any dispute shall be submitted to the courts of Alicante, Spain, except where mandatory consumer protection rules apply.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
